Construction Permit Process - State Rules

  • How Are Wetlands Activities Regulated by Idaho? Idaho's wetlands are regulated by the Department of Environmental Quality (DEQ) through its water quality certification program that implements ?401 of the Clean Water Act. The DEQ must issue a §401 certification before any person who applies for a federal license or permit conducts an activity that may result in a discharge into state waters.

  • Mitigation Measures. Certification cannot be issued unless the applicant demonstrates the discharge will comply with state water quality standards and the Clean Water Act.

Regulatory Definitions

  • Wetlands. Wetlands are protected as "waters" of the state. "Waters" means "all the accumulations of water, surface and underground, natural and artificial, public or private, or parts thereof which are wholly or partially within, flow through, or border upon" the state.

  • Wetland Categories.

  • Regulated Wetland Activities. Discharges into state waters are controlled under the state's water certification program. Applicants proposing to dredge or fill wetlands must accurately describe the area their project will impact.
